12 days after the death of Deputy Superintendent of Police M.K. Ganapathy which has rattled government of Karnataka saw a colossal development when Madikeri magistrate court has ordered to file a FIR on EX home minister K J George, IGP Pranab Mohanty and A M Prasad under section 156/3 and referred the case to Madikeri police station for further investigation. While all this unfolded K J George resigned from Bengaluru Development and Town Planning minister. Additional Judicial Magistrate Annapurneshwari also announced that Magistrate court will monitor this case. There are a lot of speculations and analysis on how this case will advance and if the justice will be delivered at all.
Even if K J George appeals to high court to quash the lower court order and get a stay, It could not stand in high court since a FIR would have been filed by then. As per IPC, a FIR has to be filed in such cases which were clearly violated in this case and the magistrate court seems furious about the way administration went about the case without registering the FIR. In this situation, high court might not encourage the case at the initial stage for hearing even if it does it will uphold the lower court’s order. It is up to the Investigation department to arrest George. The supreme court has clearly stated that the investigation team can arrest the accused if they think evidence can be tampered. In due course of the case, George will be arrested for further investigation. There is a lot of speculation that evidence pertaining to the death of M K Ganapathi could have been destroyed.
However K J George might travel abroad to escape arrest, He could be traveling to the country which doesn’t have deportation treaty with India but even if that happens congress will be in deep trouble as media will go gaga over Georges escape. The news of K J George approaching Ram Jethmalani is true but if that happens there is a huge chance of Subramanian Swamy taking up this case for M K Ganapathi since he is already spoken to his close associate Pavana Shetty on the issue. With BJP raising this issue in parliament next week M K Ganapathi’s case could well become a national news and a huge embarrassment for Congress party. BJP will go all out to corner the opposition in the parliament and might request Subramaniam Swamy to take up the case to destabilize congress in Karnataka considering the state elections are fast approaching. The suicide case of M K Ganapathi has turned out to be a battle between BJP vs Congress.
I would only hope Justice is delivered to M K Ganapathi’s family by the law of the land.
